The rule on file
N.Y. Educ. Law 6841(4); 8 NYCRR 29.7(a)(21)(ii). A total-headcount rule with a sub-cap: a pharmacist may have no more than 4 support people at one time, and no more than 2 of them may be registered pharmacy technicians performing licensed technician tasks. Pharmacy interns are exempt. Since November 21, 2025 registered technicians may work in community pharmacies (L. 2025 ch. 543).
That is the sentence the New York page states. The passages below are what the issuing body served when RxShift read it, kept as a dated record so a pharmacy and its counsel can check the sentence against the source. How a rule is read is decided by people and recorded with its date; no automated check can change a reading. RxShift reports deficiencies against this reading; it does not certify compliance, and nothing here is legal advice.
The recorded passages
Recorded word for word on the read of 2026-10-19. Each week an automated re-check opens every official source named here and confirms each passage is still on the page as served; the mark on each passage is what the newest re-check (2026-10-19) found.

Every read and every re-check, newest first
A dated read is RxShift reading the issuing body’s text and recording it in a dated report; its public note is repeated here word for word from the updates log. A re-check is the weekly automated comparison of the recorded passages against the live page. People decide every reading; a re-check never changes one.

Education Law 6841(4) states the same limits.

No change to New York's staffing limits. A pharmacist may still have no more than four support people assisting at one time, no more than two of whom may be registered pharmacy technicians performing licensed technician tasks, and pharmacy interns remain exempt from that count (N.Y. Education Law 6841(4); 8 NYCRR 29.7(a)(21)). Other New York pharmacy rules have moved this year without touching those numbers. A patient's prescription can now be transferred to another pharmacy with all remaining refills, not one refill at a time (8 NYCRR 63.6(a)(8)). Shared pharmacy services rules took effect May 22, 2026 (8 NYCRR 63.8 and 63.18) and have since been revised. The State Education Department has also proposed updating the pharmacist immunization rule (8 NYCRR 63.9) to follow a 2026 state immunization law, with permanent adoption expected in January 2027.

No change in New York. A pharmacist may still have no more than four support people assisting at one time, and no more than two of those may be registered pharmacy technicians performing licensed technician tasks (N.Y. Education Law 6841(4)); pharmacy interns remain exempt from that count, and a preceptor pharmacist may supervise no more than one full-time or two part-time interns (8 NYCRR 63.2). Separately, New York's rules on shared pharmacy services changed effective May 22, 2026 (8 NYCRR 63.8 and the new 63.18), which affects registration for pharmacies participating in shared services but does not change the staffing numbers. The bill that would require a second pharmacist above 200 prescriptions in any 14-hour period, S5625, is still sitting in committee with no vote and is not law.

New York does not cap how many hours a pharmacist or pharmacy technician may work, does not require time off between shifts, does not mandate a meal or rest break, and does not limit consecutive days worked. A bill has been introduced in four consecutive legislative sessions, most recently S5625 in 2025, that would require a second licensed pharmacist whenever a pharmacy dispenses more than 200 prescriptions in any fourteen-hour period. It has never come to a vote and is not law.

No change in New York. A pharmacist may still have no more than four support people helping at one time, and no more than two of those may be registered pharmacy technicians performing licensed technician tasks (N.Y. Education Law 6841(4)). Pharmacy interns remain exempt from that count, and the State Education Department rules updated on April 29, 2026 to let registered pharmacy technicians work in any registered pharmacy are unchanged and in force. A separate rule at 8 NYCRR 63.2 limits a preceptor pharmacist to one full-time intern or two part-time interns and allows one intern for each 5,000 prescriptions the pharmacy dispenses a year.

In New York a pharmacist may have no more than four support people helping at one time, and no more than two of those may be registered pharmacy technicians performing licensed technician tasks (N.Y. Education Law 6841(4)). Pharmacy interns do not count toward that limit. As of November 21, 2025 registered pharmacy technicians may work in any registered pharmacy, not just hospital pharmacies, and the State Education Department's rules were permanently updated to match on April 29, 2026.

What the re-check results mean
- Confirmed: every recorded passage was still on the issuing body’s page as served that day.
- Mismatch: at least one passage was not found. It is reported as it stands, a person looks, and the rows after it show what followed.
- Not allowed: the issuing body’s site does not permit automated reading, so the rule rests on its dated read, by a person where the page can only be opened in a browser.
- Nothing to match, no baseline: the record on file held no passage the re-check can match, or no report yet qualified as its baseline.
