Delaware pharmacies

How many technicians can a pharmacist supervise in Delaware?

Delaware does not set a number. There is no pharmacist-to-technician ratio in 24 Del. C. chapter 25 or in 24 Del. Admin. Code 2500.

Delaware has no technician ratio. It requires pharmacist breaks instead.

A pharmacist working six continuous hours or longer must be allowed a 30-minute uninterrupted meal break and a 15-minute break, and a pharmacist required to work twelve continuous hours an additional 15 minutes. Those are schedule rules, and RxShift checks each pharmacist shift against them before you publish.

The rules

How Delaware’s pharmacist break rule works.

No pharmacist-to-technician ratio: in 24 Del. C. chapter 25 or in 24 Del. Admin. Code 2500

A pharmacist working 6 or more continuous hours: must be allowed one 30-minute uninterrupted meal break and one 15-minute break (24 Del. Admin. Code 2500 § 21.2.5.1)

An additional 15-minute break at 12 continuous hours: 60 minutes in all (§ 21.2.5.2)

A pharmacist who is entitled to breaks: may not be required to work more than 5 continuous hours, not counting a 15-minute break, before being given the chance to take the 30-minute meal break (§ 21.2.5.3)

Hours and breaks

Delaware requires pharmacist breaks, and only the pharmacist’s.

Under 24 Del. Admin. Code 2500 section 21.2.5, published January 1, 2026, a pharmacist who works 6 continuous hours or longer must be allowed at least one 30-minute uninterrupted meal break and one 15-minute break, 45 minutes in all. A pharmacist required to work 12 continuous hours qualifies for an additional 15-minute break, 60 minutes in all. A pharmacist who is entitled to breaks may not be required to work more than 5 continuous hours, not counting a 15-minute break, before being given the chance to take the 30-minute meal break. The rule names pharmacists only. RxShift flags a pharmacist shift of 6 hours or more with less than 45 minutes of break, and one of 12 hours or more with less than 60, before you publish.

Two points are RxShift’s own reading. The rule says continuous hours without saying whether break time counts, so RxShift measures the length of the shift, the cautious reading. And the breaks are an entitlement the pharmacy must allow, so a flag means the schedule left no room for them, not that anyone was made to skip one. RxShift records one break total per shift, so it does not check that the 45 minutes is a 30-minute uninterrupted meal break plus a separate 15, or where in the shift the breaks fall.

Delaware’s pharmacy regulation sets no maximum shift length and no minimum rest between shifts. It does require records RxShift does not hold: signed staffing forms kept in the pharmacy for at least 3 years, and documentation of the corrective action taken on each staffing report, kept for at least 3 years and produced within 48 hours of the Board’s request (sections 21.4 and 21.5.3). It also requires at least one fully trained technician on the premises whenever the pharmacy department is open (section 21.6), which RxShift does not check.

Questions

Common questions

How many pharmacy technicians can one pharmacist supervise in Delaware?

Delaware does not set a number. There is no pharmacist-to-technician ratio in 24 Del. C. chapter 25 or in 24 Del. Admin. Code 2500. What Delaware regulates is the pharmacist’s working conditions: under section 21.0 of Regulation 2500, a pharmacist working 6 continuous hours or longer must be allowed a 30-minute uninterrupted meal break and a 15-minute break, with another 15 minutes at 12 continuous hours (24 Del. Admin. Code 2500 § 21.2.5).

Do technicians have a break right under Delaware pharmacy law?

Not in the pharmacy regulation. Section 21.0 gives its break entitlement to pharmacists only and names no break for technicians, technician trainees or pharmacy interns. Delaware’s general employment law (19 Del. C. § 707) separately requires an unpaid meal break of at least 30 consecutive minutes for an employee working 7.5 or more consecutive hours, with exceptions, and RxShift does not apply it.

Does a Delaware pharmacy have to close when the pharmacist is on break?

No. The regulation lets a pharmacy close for a pharmacist’s break based on the professional judgment of the pharmacist on duty. If it stays open, the pharmacist must take the break within the prescription department or on the premises and must decide whether technicians and pharmacy interns may keep working, and only prescriptions a pharmacist has verified may be dispensed (24 Del. Admin. Code 2500 §§ 21.2.5.5 to 21.2.5.7).
