New York's Pharmacy Staffing Limit: Four Support People
RxShift · October 16, 2026
Imagine you’re reviewing your pharmacy’s schedule: a pharmacist is supervising two registered pharmacy technicians performing licensed technician tasks and two clerks. That is four support people, not just two technicians. Under New York's rule, that arrangement reaches both limits: four support people total, with no more than two registered pharmacy technicians performing licensed technician tasks.
The clerks count. That is an important detail when you’re looking at who is working together, rather than just counting the people with technician licences.
Two limits apply at the same time
Under N.Y. Educ. Law 6841(4) and 8 NYCRR 29.7(a)(21)(ii), a pharmacist may have:
- No more than four support people assisting at one time.
- Within that total, no more than two registered pharmacy technicians performing licensed technician tasks.
Unlicensed support staff, described as clerks, count toward the four-person total. The total is not a separate allowance for registered technicians plus another allowance for clerks. In the example above, both groups occupy the same four-person total.
Certification does not increase the limit
Certification does not change either staffing limit. A PTCB or NHA certification is how a technician qualifies for the New York registered pharmacy technician licence.
National certification and a New York licence are not interchangeable for this count. A nationally certified person without a New York licence counts as an unlicensed person within the four-person total. Having that certification does not create an additional slot.
What changed for community pharmacies
Before November 21, 2025, registered pharmacy technicians could work only in hospitals or hospital-owned pharmacies. Community pharmacies were limited to unlicensed support staff.
Chapter 543 of the Laws of 2025 removed that restriction, allowing registered pharmacy technicians to work in community pharmacies beginning November 21, 2025. The State Education Department conformed its rules permanently, effective April 29, 2026.
The four-person total did not change; who may fill the slots and what they may do did.
Ultimately, the community pharmacy change did not increase the total number of support people a pharmacist may supervise. The four-person total and the two-person limit for registered technicians performing licensed technician tasks remain the figures to keep together when reviewing your schedule.
RxShift checks both limits on every New York schedule before it is published.
